Withdrawal Policy and Model Withdrawal Form

Consumers have a fourteen-day right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

Withdrawal policy

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party other than the carrier designated by you, take possession of the goods. If you have ordered several goods as part of a single order and they are delivered separately, the period is fourteen days from the day on which you, or a third party other than the carrier designated by you, take possession of the last item.

For contracts for the supply of digital content that is not supplied on a tangible medium (for example software licences for download), the withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (DEVACON GmbH, Lessingstraße 16, 16356 Ahrensfelde, Germany, phone: +49 30 81453320, email: [email protected]) of your decision to withdraw from this contract by means of a clear statement (for example a letter sent by post or an email). You may use the attached model withdrawal form, but this is not mandatory. You can also declare your withdrawal using our online withdrawal form. If you use this option, we will send you an acknowledgement of receipt of such a withdrawal without delay (for example by email).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to DEVACON GmbH, Lessingstraße 16, 16356 Ahrensfelde, Germany, without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

We will bear the cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Early expiry of the right of withdrawal for digital content

For a contract for the supply of digital content that is not supplied on a tangible medium, the right of withdrawal expires if we have begun performance of the contract after you have expressly consented to us beginning performance before the end of the withdrawal period, you have acknowledged that you lose your right of withdrawal by giving this consent, and we have provided you with a confirmation of the contract.

Voluntary right of return

In addition to the statutory right of withdrawal, we offer consumers a voluntary right of return of 30 days. The details and exceptions are set out in section 5 of our General Terms and Conditions. The voluntary right of return does not limit your statutory rights.
